Niru & Co LLC handles substantial corporate and commercial litigation work. This encompasses wide ranging disputes such as breach of contracts, joint ventures, shareholders’ agreements, sale of goods, international trade & letters of credit, bailment, service contracts, as well as employment and partnership disputes. The high profile and high value disputes involve assets in foreign jurisdictions such as the sale and purchase of a very large hospital, coal mines in Indonesia etc etc. These disputes involve complex transactions with cross border issues and foreign law.
The major banking dispute the Firm was involved in includes a claim against Standard Chartered Bank for losses arising out of the Madoff scandal which dealt with an array of complex banking/financial issues. We have also acted on behalf of a Swiss Bank against a Singapore law firm for losses arising from negligent advice relating to carriage of goods. We have acted for and continue to act for various local and international banks in both advisory and litigation roles.
ARBITRATION
Consistent with the Firm’s extensive and wide ranging litigation portfolio, the Firm also handles major disputes across all areas of their practice through arbitration. It also has extensive experience in mediations, neutral evaluations and mediating court actions and disputes.
The arbitrations are in respect of insurance, reinsurance, contractual disputes, etc.
Significant amongst these is the Firm’s representation of Prai Power Sdn Bhd and Allianz General Insurance Company (Malaysia) Berhad in a multi-pronged series of arbitration and court proceedings against General Electric and Sumitomo Corporation, Japan, for claims in excess of US$80 million. The Firm also has experience in arbitrations held in the London market relating to contractual disputes, salvage, charterparty and other maritime disputes and joint venture disputes.
The arbitrations were both ad hoc and under the ICC Rules, SIAC Rules, KLRCA Rules etc. It also advises and manages clients’ arbitration disputes in other jurisdictions.
INSURANCE AND REINSURANCE
The Firm has a well-established track record in handling insurance and reinsurance disputes. It has been actively involved in various litigation matters in substantial and complex cases, in Singapore, Malaysia and the region. The experience in insurance litigation work includes all classes of insurance business. (see box below)
The Firm is currently engaged as counsel in a variety of insurance matters such as marine hull claims, cargo claims, freight forwarders defences, bankers’ blanket bonds, contractors all risks claims, erection all risk claims, machinery breakdown claims, professional indemnity, negligence actions, errors and omissions and directors & officers’ liability claims, etc., etc.
The Firm has also been engaged to advise and act on matters involving substantial claims under fidelity guarantee and money policies, amongst others. The insurance and reinsurance practice of the firm also traverses specialist insurance claims involving power plants, oil & gas etc etc.
Members of the Firm have also provided advisory and consultancy work on various aspects and issues of insurance law and practice. Such advisory and consultancy work go beyond the shores of Singapore. These include established institutions such as, American Express Bank, Mastercard, J P Morgan, Schlumberger etc., etc. The advisory and consultancy work extends to regulatory and procedural matters. Examples of advisory work done on complex issues include the various regulatory framework required to set up insurance businesses under various models, issues relating to the effect and interpretation of statutory provisions such as the Insurance Acts in Singapore and Malaysia, etc., etc.
The Firm is also committed to providing, on a regular basis, seminars and workshops, touching on various issues on insurance law and practice. For example, the Firm was involved in presenting a major seminar to the state government, corporate, business and insurance community in Sarawak (Malaysia) on issues of directors & officers’ liability.
The Firm has also been engaged in designing insurance products, and drafting of various policy wordings for insurance companies, both in Singapore and in the Asia Pacific Region.
The Firm has been involved in major restructuring and management of bodily injury claims on a project basis for major insurers in the 1980s, 1990s and in the new millennium, in Singapore and Malaysia. The Firm also undertakes motor defence work for many insurers. The Motor Defence Unit in the firm manages this area of practice according to strict Standard Operating Procedures (SOPs). The performance of the unit is monitored and appraised by the clients through agreed Key Performance Indicators (KPIs).

SHIPPING, AVIATION & INTERNATIONAL TRADE
Another major practice area of the Firm is in Shipping and Aviation work. This includes both litigation and advisory work. (see box below)
On the shipping side, the Firm handles issues in relation to general admiralty law and practice, cargo claims, maritime collisions, pollution, charterparty disputes, salvage claims etc., etc.
The Firm dealt with a very substantial ship collision case involving the vessel “ICL VIKRAMAN”. This is believed to be the largest collision claim in Malaysian legal history. The issues involved in the collision were extremely complex and there were related proceedings in England and France.
The Firm has also been engaged as counsel in ship explosion cases including a major one involving the vessel “LOTUS M”, a casualty which took place outside the port limits of Singapore.
The Firm has also dealt with major oil pollution cases such as the collision between “VOLVEX DELTA” and the “HIKARI II” and the case of the “STOLT ADVANCE” where they represented numerous owners of fish farms, which suffered pollution damage as a result of the oil spill.
In more recent times in Malaysia, the Firm through their Malaysian associated office, has also acted for and advised substantial clients in shipping and maritime law and practice. These include Petronas and its subsidiary, such as Kertih Port Sdn Bhd, Malaysia International Shipping Corporation (MISC), Sabah Shell & Sarawak Shell.
The Firm has also advised and acted in several aviation and aviation related matters for Singapore Airlines and SIA Engineering Company Limited. MEDICAL & HEALTH
The Firm also handles medical and health related matters as part of its main portfolio of legal work particularly, the conduct of disputes in such matters.
In this regard, the lawyers in the Firm have handled defence work on medical negligence claims for the leading hospitals such as Mount Elizabeth, Gleneagles etc., through the insurers. The Firm’s involvement in medical negligence work also extended to Malaysia in which it has handled defence work for the IJN, Malaysia (the National Heart Institute).
The Firm also represents medical professionals in defence of negligence claims, disciplinary matters and in Coroner’s Inquiry.
MEDIA
The Firm has been involved extensively in handling media litigation work, notably in libel and slander in Malaysia. This is a major portfolio of the Firm’s practice area.
The Firm works closely with major media organisations such as New Straits Times Press, Utusan Melayu, Sun Media, (TV3), NTV7, CNBC, etc in litigation matters. This principally involves providing defence work and appearing as counsel (through the Malaysian office) in Court on behalf of these clients.
The Firm is able to also work closely with reporters and editors in providing urgent “on the spot” pre-publication advices. Such advices are typically rendered via phone, fax or emails just prior to publication. This is an example of risk management and value added services which the Firm provides.

CONSTRUCTION
The Firm provides services in building and construction matters for
established construction firms in areas such as pre-contractual advice, project
management advice and dispute resolution (including the Security of Payments

INTELLECTUAL PROPERTY
The Firm provides services in intellectual property matters in areas such as copyrights, trademarks, patents and passing off.
The Firm acts for established institutions such as Swarovski, Perodua in Malaysia and others in Singapore. The work is both advisory and litigation. The litigation part in many instances involves pre-emptive and summary actions taken on urgent basis to secure interim court orders to preserve and protect clients’ intellectual proprietary rights, etc.

Who we are
The history of Niru & Co LLC began when Niru & Co. was established in 1978. Niru & Co began as a niche practice with an initial focus on shipping and marine insurance law.
The Firm developed and expanded rapidly to become a boutique practice reputed for its specialised expertise in niche areas of the law such as, insurance and reinsurance (all classes), shipping and aviation, medical negligence, media (defamation), intellectual property, civil and commercial, energy (oil, gas, minerals and power plants) and construction.
Testimony to the standing and reputation of the Firm's recognition is that in the late 90's CMS Cameron McKenna, a top tier London based global firm, established a formal association with Niru & Co.
Further, in the year 2000, the two principal partners of Niru & Co. were invited to join Zaid Ibrahim & Co, the largest law firm in Malaysia as a Consultant and a Partner, respectively. They led the litigation division in that firm until 2004.
As from 1st June 2009, Niru & Co merged with Global Law Alliance LLC (GLA), a Singapore firm in formal alliance with SNR Denton UK LLP. The team from Niru & Co formed the Litigation Office.
As of 1st November 2016, the Litigation Office of GLA demerged to go back to practicing as Niru & Co LLC.
The singular objective of the Firm has always been to provide personalised partner level service in an efficient and affordable manner. Niru & Co LLC undertakes both advisory and litigation work in its practice areas.
The founding partner of Niru & Co, and Managing and Senior Director of the Firm is Niru Pillai. The other Senior Director is Liew Teck Huat. Alex Yeo and Priya Pillay are Directors of the Firm. They are supported by Achala Menon, an Associate Director. The Firm has a strong team of professionals made up of Senior Associates, Associates, Legal Officers and Paralegals.
One of the hallmarks of the Firm is that it has retained all its original core staff members who have been with the Firm from the beginning. They, together with several other staff members form the backbone of the Firm.
The Firm has also a veritable associated practice in Malaysia in Suflan, T H Liew & Partners. Its Malaysian operations are run along the same lines and by the same standards as in Singapore. The Malaysian associated practice can count several MNC's, PLC's and GLC's as its clients.

Niru Pillai
NIRU PILLAI, is the Managing and Senior Director and the Head of Litigation in Niru & Co LLC.
Niru is a Barrister at Law of England & Wales. He was called to the English Bar by the Honorable Society of the Inner Temple in 1976. He holds two Masters degrees from The University of Melbourne and Nottingham Trent University. The latter is an LLM in Advanced Litigation which he attained with distinction.
He is also an Advocate & Solicitor of the Supreme Court of Singapore since 1978. In 1990, he was admitted as a Barrister & Solicitor of the Supreme Court of Victoria, Australia. He is also a Fellow of the Chartered Institute of Arbitrators, UK and a Fellow of the Singapore Institute of Arbitrators.
Niru has appeared as counsel in the Privy Council with Anthony Clarke QC (Lord Justice Clarke, formerly a member of the Supreme Court of England and the Master of the Rolls, England and Wales) and Gordon Pollock QC in two major appeals (reported in Lloyds Law Reports, All England Law Reports and Lloyds Maritime Law Quarterly). One of the decisions led to changes being made to marine insurance terms by Lloyds.
Niru has appeared as counsel in all the Courts in Singapore, including the Court of Appeal, Singapore’s apex Court.
He has also appeared as lead counsel on an ad-hoc basis in the High Court of Brunei.
He has represented several parties in Commissions of Inquiry in Singapore.
Several cases in which he has been involved as counsel and/or solicitor, are landmark decisions in Singapore and are reported in Singapore, Malaysian and English law reports. (see our Reported Cases Link)
Niru also sits as an arbitrator in domestic and international arbitration disputes.
Niru’s forte covers all aspects of litigation work straddling insurance, reinsurance, shipping and admiralty, medical and healthcare, professional negligence, aviation, media (defamation), commercial, corporate, civil, banking, international trade, employment, energy and utilities (oil and gas or power plants) and arbitration. In many of these areas, Niru also does advisory work.
Niru is also an exponent of Plain English Drafting having been trained by Professor Robert Eagleson of Sydney. He has also been involved in Advanced Litigation training for lawyers in Malaysia and Brunei (as specialist counsel to the Attorney General’s Chambers in Brunei).
Niru has had the privilege of speaking at many conferences and seminars in the Asia Pacific region on a variety of subjects including the Bhopal Tragedy in 1985 (at the invitation of the Indian Institute of Insurance).
Niru retired from the National University of Singapore (NUS) as an Adjunct Associate Professor in July 2008 after having taught law since 1993 for engineering students at the Faculty of Engineering. He has the distinction of having been conferred the NUS Excellent Teachers Award in 2003.
Niru speaks and writes English, Tamil and Malay and speaks Malayalam.
His private interests are reading, writing, classical music, travel, mountain trekking and community/social work.

Liew Teck Huat
EXPERIENCE
Teck Huat has extensive litigation experience particularly in the areas of insurance, re-insurance, shipping, aviation, media (defamation), energy, international trade, corporate, commercial, civil and intellectual property.
He has appeared before the Courts at all levels in Singapore as well as in Malaysia. Teck Huat’s wealth of experience includes establishing many good points of law in cases which have been reported. Some of these are landmark decisions in Singapore and Malaysia.
Teck Huat also advises and represents the biggest media organization in Malaysia in defamation matters and appears as its counsel on a regular basis.
He was admitted to the Brunei High Court on an ad hoc basis as lead counsel for a trial in a defamation action in which he successfully argued the extended parameters of the defence of qualified privilege as expounded by the House of Lords in Reynolds v Times Newspaper [1999] 3 WLR 1010.
CAREER
Teck Huat was called to the Singapore Bar in 1989. He commenced practice with Niru & Co in March 1989. In 1991, when Niru & Co merged with Harry Elias & Partners, he became a partner of that firm. In 1994, he continued to practice as a partner of Niru & Co.
In October 2001, Teck Huat ventured into Malaysia as well to further his legal practice. He joined Zaid Ibrahim & Co. and helped in the establishment of its insurance, reinsurance and shipping practice. He led that group in the litigation division until he left Zaid Ibrahim & Co. in June 2004 to start T H Liew & Partners, now known as Suflan T H Liew & Partners.
Apart from his extensive litigation practice, Teck Huat also conducts regular conferences and seminars. In 2003, Teck Huat presented a paper on Maritime Arbitration at a seminar organised by the Regional Centre for Arbitration, Kuala Lumpur.
He was a teaching member of the Singapore Law Society Advocacy Committee from 1996 to 1999. He was also tutor in law in the Faculty of Engineering of the National University of Singapore.
From 2009 to October 2016, Teck Huat was a Senior Director at Global Law Alliance LLC - Litigation Office.

Alex Yeo
Alex is a Director of the Firm.
Alex graduated from the University of Sydney in New South Wales, Australia with an LL.B (Honours) degree in 2007. He also holds a B.A. (Merit) degree in Economics and Political Science from the National University of Singapore (NUS).
Alex was admitted as a Lawyer and Solicitor to the Supreme Court of New South Wales and the High Court of Australia in 2007. In his time in Sydney, Australia, he was an Associate engaged in corporate practice with a mid-sized city firm.
Alex returned to Singapore in 2008 and joined the Ministry of Foreign Affairs (MFA) where he was appointed as a Foreign Service Officer (Political).
Alex left MFA in 2010 to join Global Law Alliance LLC - Litigation Office and was admitted as an Advocate and Solicitor of the Supreme Court of Singapore in 2012.
Alex handles a broad spectrum of litigation and international arbitration matters. Priya Pillay
Priya is a Director of the Firm.
Priya graduated from the London School of Economics & Political Science (LSE), University of London with an LL.B (Honours) degree in 2000. Priya went on to read for her Master of Laws (LL.M) in 2004 and Master of Arts (MA) in International Studies and Diplomacy in 2005 from the School of Oriental & African Studies (SOAS), University of London.
In 2007, Priya completed her Bar Vocational Course and Graduate Diploma in Professional and Legal Skills with the Inns of Court School of Law, and was called as a Barrister-at-Law by the Honourable Society of the Inner Temple.
Priya joined the Ministry of Foreign Affairs in 2008 as a Foreign Service Officer (Political & Economic).
In 2010, she joined Global Law Alliance LLC - Litigation Office and was admitted as an Advocate & Solicitor of the Supreme Court of Singapore in 2012. During her Part B (Bar) Course, Priya was awarded the Singapore Law Society’s prize for Best Speaker in Advocacy.
In 2015, Priya completed and obtained the Graduate Certificate in International Arbitration from the National University of Singapore.
Priya’s specialised practice areas are in family, insurance, reinsurance, shipping, medical negligence and professional negligence litigation. She also handles other civil and tort disputes. She also does arbitration and alternative dispute resolution work in the Firm.
Priya is an SMC Accredited Mediator and a SIMI Accredited Mediator – Level 1.
Outside work, Priya assists in running Community Legal Clinics at the Potong Pasir Community Club and at One-Stop@PayaLebar, respectively, under the auspices of the Law Society's Pro-Bono Services.

Achala Menon

Joshua Ho is an Associate of the Firm.
